Terms of Service
These Terms form an agreement between you and Next Dimension Fun LLC ("VeraTime Race," "we," "us"). By accepting or using VeraTime Race, you agree to them. If you use VeraTime Race for an organization, you represent that you may bind it.
1. Eligibility and athlete data
You must be at least 18 and legally able to agree, or act as an authorized representative. You are responsible for authority to enter, use, display, export, or share athlete information, including data about minors, and for providing required notices and obtaining required permissions.
2. Service and race responsibility
VeraTime Race helps crews capture, synchronize, correct, calculate, and export timing information. You remain responsible for race safety, official results, verification, backups, redundancy, device readiness, radio procedures, and compliance with sporting rules. Never rely on VeraTime Race as the sole record or as a safety-critical service.
Virtual courses, race organization and safe locations
YOU SET UP AND USE ANY VIRTUAL COURSE, START LINE, FINISH LINE, CAMERA GATE OR TIMED ACTIVITY AT YOUR OWN RISK. A marker, map, camera overlay, GPS position or app instruction is not permission to race and does not mean that a location is safe, open, authorized or supervised.
You and the organizer are responsible for inspecting and selecting safe locations and routes, obtaining landowner and ski-area permission and any permits, selecting appropriate start/finish zones and run-out areas, protecting bystanders, and arranging qualified supervision and emergency procedures. Consider terrain, traffic, visibility, weather, avalanche conditions, equipment, ability, age and fatigue. Stop, relocate or cancel the activity when conditions are unsafe. Do not place gates, phones, tripods or other equipment where they obstruct a trail, lift, road, access route or emergency response.
Follow all ski-area and landowner rules, closures, signs and patrol instructions, applicable sport and competition rules, and all laws and regulations in the country, state, province and locality where you operate. Stay in control, respect rights of way and others' safety, and never enter closed or restricted terrain, trespass, create an unauthorized race, or encourage another person to break a rule. Do not operate the app while moving if doing so distracts you or increases risk. A phone, Bluetooth relay or cloud connection is not an emergency communications system.
Coaches, clubs, directors and organizers retain responsibility for participant eligibility, informed permissions, appropriate adult supervision of minors, instruction, staffing, equipment and insurance where required. We do not inspect, approve, control or supervise your course or event, supply a ski patrol, certify an organizer, or warrant that using the app satisfies a governing body's timing or safety requirements. Contact venue staff, ski patrol or local emergency services directly in an emergency.
Physical activity risks and responsibility
Skiing, snowboarding, racing and other physical activities involve risks including collisions, falls, changing snow and weather, terrain hazards, equipment failure, serious injury and death. Participation must be voluntary and consistent with your abilities and health. Where lawful, you assume the inherent risks of your chosen activity and the risks created by your own course placement, misuse, failure to follow rules or failure to use appropriate precautions. Do not use timing results, coaching comments or rankings as medical advice or a reason to continue an unsafe activity.
Where applicable law permits, you release Next Dimension Fun LLC and its personnel from claims arising solely from inherent activity risks or your own unsafe or unlawful conduct. This is not a release of our negligence or other responsibility that cannot legally be waived. No provision authorizes unsafe conduct, replaces a required venue waiver, or waives a minor's rights through another person's unsupported acceptance.
3. Accounts and security
Keep devices, passwords, race codes, and role credentials secure. You are responsible for activity under your account and for promptly reporting suspected unauthorized access. Do not share credentials beyond authorized crew members.
4. Purchases and subscriptions
Prices and renewal terms are shown before purchase. A 24-hour pass does not renew. Monthly and annual subscriptions renew until canceled through the applicable Apple, Google Play, or Stripe account. Store refund and cancellation rules apply. Restoring a valid purchase is not conditioned on accepting newly updated terms, although future purchases or continued use may require current acceptance where lawful.
5. Acceptable use
Do not misuse the service, interfere with systems, reverse engineer except where law permits, bypass access controls, upload unlawful or harmful material, impersonate others, violate privacy or intellectual-property rights, or use VeraTime Race for unlawful discrimination or surveillance.
6. Ownership and feedback
VeraTime Race and its software, branding, and content are owned by Next Dimension Fun LLC or licensors. You retain rights in data you lawfully provide and grant us a limited license to host, process, transmit, and display it to provide and improve the service. Feedback may be used without restriction or compensation.
7. Third-party services and connectivity
VeraTime Race depends on devices, operating systems, networks, app stores, Firebase/Google Cloud, Apple, Google Play, Stripe, Brevo, and other services outside our control. We are not responsible for outages, signal loss, device clock changes, battery failure, platform policy changes, carrier failures, delayed synchronization, or third-party acts, except to the extent applicable law makes us responsible.
8. Data loss and backups
You must maintain appropriate independent records and exports. Synchronization, storage, recovery, and export may fail. We do not promise that data will never be lost, delayed, duplicated, corrupted, or unavailable.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERATIME IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR RESULTS. Some jurisdictions do not allow certain disclaimers, so they apply only to the permitted extent.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXT DIMENSION FUN LLC AND ITS MEMBERS, PERSONNEL, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR RACE OPPORTUNITIES; OR SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
Our total liability arising from VeraTime Race will not exceed the greater of (a) US $100 or (b) amounts you paid for VeraTime Race in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited, including liability that cannot be limited for fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or mandatory consumer rights.
11. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Next Dimension Fun LLC and its personnel from third-party claims arising from your unlawful use, your race operations, your data or exports, your violation of these Terms, or your failure to obtain authority for athlete data. This applies only to the extent caused by your conduct, does not cover our negligence or misconduct, and does not shift responsibility that the law prohibits shifting. We will provide prompt notice and reasonable cooperation and an opportunity to defend a covered claim; no settlement may impose an admission or obligation on us without our consent. Mandatory consumer protections remain unaffected.
12. Suspension and termination
We may suspend access to protect users or systems, comply with law, address nonpayment, or respond to material breaches. You may stop using VeraTime Race and request deletion. Provisions intended to survive will do so.
13. Governing law and disputes
Michigan law governs, without regard to conflicts rules. Subject to mandatory consumer law, state and federal courts located in Kent County, Michigan have exclusive jurisdiction. Before filing, each party should send written notice and allow 30 days for informal resolution. These Terms do not require arbitration and do not waive any non-waivable right.
14. Apple terms
For an iOS app, this agreement is between you and Next Dimension Fun LLC, not Apple. Apple has no obligation to furnish maintenance or support and is not responsible for claims relating to the app except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions.
15. Changes and contact
We may update these Terms. Material changes may require renewed acceptance. Contact legal@vera-time.com or visit Support. If any provision is unenforceable, the rest remains effective. Failure to enforce is not a waiver.
